# Otherlands Terms of Service **Effective date:** 2026-09-20 **Operator:** Jordan Nakamoto, doing business as Otherlands **Contact:** support@otherlands.app · [MAILING ADDRESS] These Terms govern your use of Otherlands, including its website, accounts, game tools, generated worlds, and credits. By using Otherlands, you agree to them. If you do not agree, do not use the service. ## Accounts and age You must be at least 13 years old to use Otherlands. You must provide accurate account information, keep your sign-in credentials secure, and promptly tell us about unauthorized use. You are responsible for activity through your account where permitted by law. We may suspend or terminate accounts that violate these Terms, create risk, or are required to be suspended by law. ## Credits, payments, and refunds Otherlands may sell prepaid credits for specified in-product generation features. Prices, credit amounts, and what a feature costs are shown before purchase or use. Payments are processed by Stripe; we do not receive your full payment-card number. Credits are not money, are not transferable, have no cash value, and may be used only in Otherlands. We may correct an obvious pricing or technical error. Except where required by law, credits are non-refundable once used. For an unused-credit purchase, billing error, duplicate charge, or other refund request, contact support@otherlands.app with the purchase details. A refund, chargeback, or dispute may reverse the associated credit grant and can leave the account unable to make further paid requests until resolved. ## Your content and generated content You retain any rights you have in prompts, worlds, campaigns, characters, and other content you submit to Otherlands ("Your Content"). You grant us the limited, worldwide right to host, copy, process, transmit, and display Your Content only to operate, secure, troubleshoot, improve, and provide Otherlands. Otherlands may generate text, images, audio, or game material from Your Content. Generated material can be inaccurate, incomplete, similar to material created for others, or unsuitable for your intended use. You are responsible for reviewing it before relying on, sharing, or using it. We do not claim ownership of generated output to the extent you receive rights in it, but cannot guarantee that output is unique or available for any particular use. Worlds and campaigns are private to the account that created them unless Otherlands later provides an explicit publishing feature. Do not submit content you do not have the right to submit. ## Acceptable use You may not use Otherlands to break the law; infringe intellectual-property, privacy, or publicity rights; impersonate a person or organization; distribute malware; interfere with the service; bypass security, rate limits, payment controls, or access restrictions; scrape or harvest data; submit content that exploits or sexualizes minors; or use the service to threaten, harass, defraud, or facilitate real-world violence or illegal activity. You may not represent generated material as factual advice in situations where people may reasonably rely on it for medical, legal, financial, safety, or other high-stakes decisions. ## Service changes and termination We may change, suspend, or discontinue features when reasonably necessary for operation, security, legal compliance, or product development. We will not intentionally delete active private content except to enforce these Terms, comply with law, protect the service or others, or process a valid deletion request. We may retain records where reasonably necessary for security, fraud prevention, disputes, accounting, or legal obligations. ## Disclaimers and liability OTHERLANDS IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, AND ACCURACY. WE DO NOT GUARANTEE THAT GENERATED MATERIAL IS CORRECT, UNIQUE, OR ERROR-FREE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, Jordan Nakamoto AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR BUSINESS. OUR TOTAL LIABILITY FOR A CLAIM ARISING FROM OTHERLANDS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR OTHERLANDS IN THE 12 MONTHS BEFORE THE CLAIM OR (B) US$100. Some jurisdictions do not allow some limitations, so they may not apply to you. ## Governing law and changes These Terms are governed by the laws of the State of Oregon, United States, excluding its conflict-of-law rules. Courts located in Multnomah County, Oregon have exclusive jurisdiction, except where applicable law provides otherwise. If we make a material change, we will post the revised Terms with a new effective date. Continued use after the effective date means you accept the revised Terms.
